Terms and Conditions

Introduction

These Terms and Conditions govern your use of services provided by Wonder Seas (“we,” “us,” or “our”) including speedboat tours and related activities. By booking our services, you (“the customer,” “you,” or “your”) agree to comply with and be bound by these Terms and Conditions. Please read them carefully before making a booking.

Booking and Payment

Booking Process: Bookings can be made through our website, by email, by phone, or through authorized travel agents. All bookings are subject to availability and confirmation.

Payment Methods: We accept payment via credit/debit cards, bank transfers, and other online payment methods through our payment processor Omise.co. All payment information is securely processed in accordance with our Privacy Policy.

Cancellation and Refund Policy

By Customer:

• Free cancellation within 48h of booking. Date changes free with 48h+ notice, subject to availability.
• For booking changes or cancellations, please contact us at reservation@wonder-seas.com

By Wonder Seas:

• We reserve the right to cancel tours due to unfavorable weather conditions, insufficient participants, or other circumstances beyond our control that may compromise safety or service quality.
• If we cancel your tour, you will be offered an alternative date or a full refund.

Weather Conditions: The captain/tour guide reserves the right to change the itinerary or cancel the tour due to adverse weather conditions or safety concerns. In such cases, we will endeavor to provide an alternative tour or date. If this is not possible, a full or partial refund may be provided at our discretion.

Health and Safety

Health Requirements: Participants must be in good physical health to join our speedboat tours. The following individuals are not permitted to join our speedboat tours:

• Pregnant women
• Children under 1 year of age
• Individuals with severe heart conditions, high blood pressure, or back problems
• Persons under the influence of alcohol or drugs

Safety Instructions: All participants must follow safety instructions provided by our staff at all times. Life jackets must be worn as instructed. Failure to comply with safety instructions may result in exclusion from the tour without refund.

Liability and Insurance

Liability Limitation: While we take all reasonable measures to ensure your safety, speedboat tours involve inherent risks. By booking our services, you acknowledge and accept these risks. We are not liable for any injury, illness, death, loss, damage, expense, or other claim that may arise from your participation in our tours except where caused by our proven negligence.

Insurance: We maintain insurance coverage as required by Thailand's Tourism Business and Guide Act. However, we strongly recommend that customers obtain comprehensive travel insurance that covers adventure activities and medical emergencies.

Personal Belongings: We are not responsible for any loss, theft, or damage to your personal belongings during the tour. Valuables should be left in your hotel safe whenever possible.

Customer Behavior

We expect all customers to:

• Respect the environment, marine life, and cultural sites visited
• Treat our staff and other participants with courtesy and respect
• Follow all instructions given by our tour guides and boat crew
• Not engage in any illegal, disruptive, or dangerous behavior

We reserve the right to refuse service or terminate participation without refund for customers who violate these expectations or whose behavior endangers themselves, other participants, or staff.

Force Majeure

We shall not be liable for any delay or failure to perform our obligations if such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to natural disasters, adverse weather conditions, governmental actions, civil unrest, epidemics, or pandemics.

Complaints and Dispute Resolution

If you experience any problems during your tour, please inform our staff immediately so that we can address the issue. Any complaints that cannot be resolved during the tour should be submitted in writing to reservation@wonder-seas.com within 7 days of your tour date.

Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Thailand.

Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services following any changes indicates your acceptance of the revised Terms and Conditions.
